CMS Derks Star Busmann has assisted Stichting Het Open IJnde in the development of 'het Open IJnde', a residential building on IJburg. A unique feature of this development is that it has been designated by the municipality of Amsterdam as a collective private commission, where the future owners participate in a foundation. The foundation will be responsible for the further development at its own expense and risk, without the intervention of a property developer.

This is one of the first developments in the Netherlands to be set up in this way. CMS Derks Star Busmann advised on developing the contract with the municipality, the formation of the foundation and drawing up contracts with the individual participants and the contractor concerned. In addition, the notarial transfer of title by the municipality to the foundation, the division into apartment rights, the individual selling off of individual units to all the participants and the financial settlement was all completed in a single day.

Manfred de Kok and Hein van der Meer, together with Jasper Kampherbeek, were responsible for the civil and legal structuring, while Madeleine van der Wal, Tine van Gent and Susanne Simonis were involved with the notarial aspects of the development.
